The Property Register is
one of the 2 main documents of title (often called
Title Deeds). It contains a description of the
property, its tenure, the name and address of
the owners, purchase price, details of mortgages
and other charges, covenants etc. We also search,
as a matter of course, the Day List Entries in
respect of any pending applications affecting
the property. The freehold and leasehold Property
Registers, and the Lease are often required by
Property Managers. As the Lease is not a public
document the written consent of the owner (or
a party to the lease) is required. |

Brine Searches, Coal Mining Searches, etc.

This search is a prerequisite
to any boundary dispute, and is essentially
a copy of all the available Land Registry
documents for both adjoining properties,
together with details of Legal Presumptions
that apply in the absence of contrary agreement
(which, if there is any such contrary agreement,
is usually expressed in the documents provided).
It is difficult to see how a boundary dispute
can be resolved without first examining these
documents, and more often than not, these
documents are all that is required to resove
the dispute. |
