What do I receive
when ordering a Title Register Search? |
If the property
is registered you will receive the Title Register,
the Title Plan and details of all the Burdens
affecting the property. These are all included
within the price. If the property is not registered
you will instead receive an extract from the post
1993 and pre 1993 Sasine Registers and an Index
Map Plan. If registration is pending you will
receive a copy of the Applications Register and
Index Map. |

What information
do these documents contain? |
The registered
documents contain the title number, the tenure,
the names and addresses of the owners, the purchase
price, details of mortgages and charges affecting
the property, a title plan and details of the
burdens affecting the property. The sasine registers
provide similar information but with less detail.
The Index Map plan is only a very rough draft
plan. The Applications Register identifies the
owners and provides a Title Number; other information
is scant and depends on its level of progression
towards registration (which can take several
years). |

What information
is contained in an Inhibitions Search? |
Details of pending
or current bankruptcy petitions or orders against
the stated person together with their names
and addresses at the time of the order. |

How do I make a Property
Prices Search and what information can I expect
from it? |
A search is made
for any 6 month period, usually the last 6 months
for a specified postcode area. The first series
of digits in the postcode are used together
with the first numeral of the second series
of digits, e.g. GL1 5. This will provide a list
of all the recorded sale prices during this period
within the stated postcode area, together with
the full addresses. |

How do I search for
a property if it does not have a full postal address?
|
The application
form will
ask you to provide the addresses of
2 nearby properties. We will then obtain a copy
of the index map for the surrounding area and
send a copy to you so that you can mark the plan
and return it to us, identifying the property
to be searched. |

Can I search by name
instead of address? |
Yes. You should
provide the full name if possible, together
with the full name of the spouse, if there is
one and if you know it. |

Can I order more
than 1 search at a time? |
Yes. By applying
for a property search from the "Order Now" button
on the top menu you will be given the option
of searching for up to 20 properties all on the
same form. Please note that if you order from
the "Title Deed Searches" button you will not
be given the option to order more than 1 search
from the same form. |

Is all land in
Scotland registered? |
No. However,
extracts of the Sasine Register are almost always
available for unregistered properties, and these
usually provide similar information to a registered
title.

Can I expect all
search results the same day instructions are given? |
All registered
properties will be dealt with the same day,
as will most of the unregistered properties.
However, because the Sasine Register is description
based there may be difficulties in tracing the
property in which case it will be necessary
to instruct the Registrars of Scotland to investigate
the matter themselves (at our expense). This
may take 7-10 days, depending on the complexity
of the search. This will not result in additional
fees to you. |

The property was
sold recently but does not appear as a registered
property. Why? |
| In Scotland, registration of titles
can take more than a year to register. During
this period the title will appear in the Applications
Register and brief details of the title can be
obtained by searching this register. These details
include the owner's name and address. |
