Common Land & village Green

A Common Land Search is usually made on land
that has never been built on or which at one
time may have belonged to a Lord of the Manor,
a town or Village green or any other land
you may believe to be common land, i.e. land
used by the community at large. The Search
can also be carried out on small vacant urban
plots of land as these could be subject to
common rights. Many Common Land registrations
affect small areas of land such as grass verges
between properties and the public highways.

The Flood Risk report contains illustrated
official details of geographical and water features

as they are now and as they may be in the future.
The report is very comprehensive and averages

This is the main search carried out by solicitors
when first instructed by you to purchase a
property. It is a record of many local matters
affecting a property that will not have been
registered against the property at the Land
Registry.
This search is primarily made to ensure that
the local council are not planning to build
a new road through or near to the property,
and that there are no known plans to force
you to sell the property to it as part of
a redevelopment scheme etc, and that there
are no outstanding obligations to pay money
to the council that have been registered by
them against the property (as opposed to the
last owner of the property).

The search in fact determines if the property
lies within the historical boundary of a tithe
district or parish. It also provides insurance
details and prices for use in the event that
such a liability is determined.
If the property is near a church or on land
that used to be owned by some of the older universities
there may be an obligation to pay towards the
repairs to the chancel of the local parish church.
Chancel Repair Liability affects millions of
acres of property in England & Wales, and
should be made when buying a property. A recent
case in the Court of Appeal held that the potential
liability for repair could extend into the hundreds
of thousands of pounds - in that case the property
owner was ordered to pay the sum of £256,000,
with £250,000 extra to pay in legal costs.
