Community Right to

Part 2 of the Land Reform
(Scotland) Act 2003 creates the
rural community 'pre-emptive' right to buy.
In order to have the right to buy when land
is marketed for sale, community bodies will
require to have pre-registered their interest.
Applications for registration are made to
Scottish Ministers who decide whether registration
will be allowed. Rural community bodies'
interests in land will be registered by the
Keeper of the Registers of Scotland (RoS).
The Act also stipulates the information which
must be contained in the Register. The Register
will reflect the information supplied to
RoS by the Scottish Executive Environment
and Rural Affairs Department (SEERAD), and
therefore RoS cannot be held liable for any
inaccuracies in the information supplied
to them and entered in the Register in accordance
with their statutory obligations.
